TERMS OF SERVICE (TOS) 🐾
By placing a commission order with ChouxCrexm, you automatically agree to all the terms listed below. Please read them carefully.
1. General Terms & Payment
• 1.1. Platforms & Ordering Methods:
• We accept commissions through various platforms, including VGen and Ko-fi. Direct orders via Twitter DM are also accepted.
• This TOS covers all forms of work, including custom illustrations, YCH (Your Character Here), and Adopts (future sales).
• 1.2. Payment: Full payment is required upfront before any work begins.
• 1.3. Communication: English is not my first language. To ensure accuracy, please provide your brief using clear, simple language and bullet points to avoid any misunderstandings regarding your request and character details.
• 1.4. Turnaround Time (TAT):
• The estimated delivery time will be confirmed on a per-piece basis, depending on the complexity and my current queue.
• The TAT begins only after the final brief and full payment are both received.
• TAT does not include weekends or public holidays.
2. Copyright & Usage Rights
• 2.1. Copyright:
• The artist (ChouxCrexm) retains all copyrights to the commissioned artwork.
• The artist reserves the right to post the finalized piece as a portfolio example (with a watermark, if deemed necessary).
• 2.2. Personal Use (Automatic):
• The client is automatically granted Personal Use rights (e.g., profile pictures, private printing, desktop wallpapers, personal use on non-monetized sites).
• Credit to the artist must be given when posting the artwork online.
• 2.3. Commercial Use Policy:
• A. Streaming/Live Broadcast Use (FREE): The client is automatically permitted to use the commissioned artwork in a streaming context without an extra fee (e.g., as overlays, alerts, or on a monetized streaming channel).
• B. Merchandise/Goods Sales (100% Fee): If the artwork is used to directly generate profit through the sale of goods (e.g., merchandise, printed goods, or any product/service other than live streaming), a Commercial Use Fee of +100% (double the base price) must be purchased.
• Commercial Use must be requested and quoted upon initial order.
• 2.4. AI/NFT Prohibition: The client is strictly prohibited from using the commissioned artwork, or any elements from it, for AI generation/training or Non-Fungible Tokens (NFTs).
3. Commission Content & Style
• 3.1. General Style: Our work utilizes various art styles as displayed in our portfolio (e.g., Chibi, OCs, Fanart, Semi-Furry).
• Style Note: My work utilizes a textured brush style and is not a sharp, vector-based lineart.
• 3.2. Acceptable Content (I Will Draw): I accept light-themed content (e.g., simple swimwear, fantasy outfits).
• 3.3. Non-Acceptable Content (I Won't Draw): Full NSFW/Explicit content, Complex Mecha/Robots, Excessive Gore/Violence, Hate speech/discriminatory content, or anything that violates the platform's TOS.
4. Process & Revisions
• 4.1. Workflow: Work progresses in stages: Sketch > Lineart > Coloring > Final Delivery.
• 4.2. Sketch Stage:
• You will receive the initial sketch and can request 2 (two) free revisions for major changes (pose, expression, or composition).
• Any revision beyond the second one will incur an additional fee [$5 USD per revision].
• 4.3. Coloring/Final Stage:
• After colors are applied, only 1 (one) free revision for minor adjustments (e.g., color correction, small detail change) is permitted.
• Major structural changes are NOT permitted at this stage and will be treated as a new commission.
• 4.4. Artist Error: Any mistake made by the artist (not matching the initial brief) will be corrected free of charge.
5. Cancellation & Refund Policy
• 5.1. Cancellation by Client:
• Full Refund: Available only if the commission is cancelled before any work (Sketching) has begun.
• Partial Refund: If cancelled after the Sketch has been sent, a partial refund will be provided (50% refund) to compensate for time and labor invested.
• 5.2. Cancellation by Artist: I reserve the right to cancel and issue a full refund at any time if the client's behavior is inappropriate or the commission falls outside my comfort zone.
